NHIS FROM THE SHARI'AH PERSPECTIVE?

By
Ibn Abdillah As-sudaisiy Al-Iloori

May Allaah bless one of our noble teachers, Ustadh Sa'eed Hamzah. He answered an important question on NHIS scheme and its anti-Islaamic flavours. He said and I quote:

Insurances are harām as it is genellay involved gambling and sometimes plus Riba, both are haraam. The payment for un-certainty is gambling in Sharee'ah. If one is forced by the Government then it has to be taken. But if one is given to take his choice it is strictly haraam at involves gharar (pre-payment for uncertainty) which the NHIS has seen as a condition where it reads: " It is a pre-payment plan where participants pay a fixed regular amount. The amount/funds are pooled, allowing the Health Maintenance Organisations (HMOs) to pay for those needing medical attention. It is primarily a risk sharing arrangement." [End of quote]

Me: A lot of people are involved in this illegality. Despite the fact that we have Muslims at the helm of affairs, what have they been able to do to stop this haram? Even on the issue of Islaamic banking, we still have a long way to go. Reliable reports show the only one "Islaamic" Bank is not as Islaamic as we think. Why can't the Muslims have their own separate shar'iah compliant health scheme? This system is entirely hostile to the shar'iah and Muslims in many ways, yet they claim that we have religious rights. Why is it so difficult to prohibit, zina, music, alchohol and gambling for Muslims in this country? Democracy is out to destroy people's hereafter with cheap and fake worldly enjoyment.

May Allaah guide us
