Ibn Abdillah As-sudaisiy Al-Iloori

The happenings in our society these days is enough a reason why every muslim daa'iy (caller or preacher) must pursue and obtain at least a considerable knowledge in shari'ah or any of its equivalent to be qualified to speak or write meaningfully and positively on shari'ah related issues. 

Issues of Islamic law is not based on common sense, it is based on texts. Common sense is only meant to assist us in arriving at a just conclusion on a given text. It is not for us to use our intellect to make a separate law that doesn't have any bearing in the shariah. If someone cannot cite the Qur'an, Sunnah or the Practice of the Sohaabah رضي الله عنهم, why not just keep mute? When Boko Haram crisis first started, some people were supporting them thinking it was a jihad. Some people were supporting ISIS and other relevant organizations. They fell into this error due to their lack of knowledge and understanding of what jihad is all about.

Allaah سبحانه وتعالى delibrately created us into this complex and terrible polity called Nigeria, and we are going to be judged by Him accordingly. He knows our capability under the man-made constitution. Previous pious Muslims that died under the same system may not be said to have died up kufr just because they were ruled by democratic law. Scholars have ruled on this matter in their juristic verdicts. Note that I am not justifying democracy as a form of government here. I hate the system with passion. But the point here is that we cannot establish the shari'ah through means that are not sanctioned in the Book of Allaah and the Sunnah of His Messenger صلى الله عليه وسلم. We can't have a shari'ah state with mere emotional violence and killing of innocent souls. 

The non-Muslims are not to be killed merely because they are not Muslims. The Muslims are not to be killed just because they are under a kufr system. The help of Allaah will only come if we follow the path of the path of the salaf to achieve whatever we want to achieve. When the help of Allaah and victory comes, the shari'ah would be embraced by all and sundry. (Suratu Nasr). This victory is what we need to wait for as we strive tirelessly to establish the foundations of Islaam in our various home and the society at large.

The first Islamic state in Madeenah was not established with senseless killings, suicide attacks and wickedness. It was established with sincerity, steadfastness and determination. That was why it was very easy for the Jews and Christians to sign the Madeenah Pact without. Allaah does not put the remedy for a particular disease in what is clearly haram. Killing of innocent souls (muslim or non-muslim) without any just cause is not a valid means of establishing a verile shari'ah state. It is just like using alchohol to cure cough, It will not work. There are several hadiths of the Prophet صلى الله عليه وسلم on this. We can only fight those who fight us. Taking people's life unjustly is not allowed under the shari'ah. Allaah says:

مَنْ قَتَلَ نَفْسًا بِغَيْرِ نَفْسٍ أَوْ فَسَادٍ فِي الْأَرْضِ فَكَأَنَّمَا قَتَلَ النَّاسَ جَمِيعًا وَمَنْ أَحْيَاهَا فَكَأَنَّمَا أَحْيَا النَّاسَ جَمِيعً

Whoever kills a soul unless for a soul or for corruption [done] in the land - it is as if he had slain mankind entirely. And whoever saves one - it is as if he had saved mankind entirely.. [Surat Al-Ma'idah 32, Saaheeh International]
